Verification of Lawful Presence and Authority to Work
Requirement: All applicants for a Texas medical license (new or renewal) must submit documentation proving lawful presence in the U.S. from the TMB’s approved list: TMB’s list of acceptable documents.
Why this is required?: Under federal law (8 U.S.C. § 1621), a professional license is considered a public benefit, and only individuals lawfully present in the U.S. are eligible.
Impact on licensure:
· Applications cannot be approved until documentation is submitted
· Documents must be valid (not expired) at the time of issuance or renewal
Effective date:
March 1, 2026: Requirement applies to all license renewals
Temporary extension (May 2026 expirations):
· Licenses expiring May 31, 2026 are automatically extended to June 30, 2026
· This allows time to submit lawful presence documents
· No change to future renewal cycles (May 31 remains the permanent expiration date)
HRO Tools are used by HROs throughout the world. Using one or several of these standardized, evidence-based tools in your practice will lead to better, more concise and patient safety focused care. Please follow the SBAR process: Communicate critical information clearly.
Example:
Situation: “Patient has new chest pain”
Background: “Recent MI, admitted yesterday”
Assessment: “Pain not relieved by meds”
Recommendation: “Request evaluation now”
Patient Satisfaction/Engagement Surveys: The importance of “Active Listening”
There is a provider Listening Toolkit that includes links to short videos to improve listening, PowerPoint presentation and white papers/articles that are about listening. The Toolkit is on the Harris Health intranet under Office of the CME, Medical Staff Services, Provider Listening Toolkit. Listening Toolkit Link (external link)
Language Access Services
Harris Health complies with Title VI of the Civil Rights Act of 1964 and Section 1557 of the Affordable Care Act by taking reasonable steps to provide its limited English proficiency (LEP) patients and/or their Companions with meaningful access to language assistance services through qualified interpreters and translators and by empowering medical staff members who have been deemed qualified (i.e., Qualified Bilingual Workforce members) to directly converse with their patient and/or their patient’s companion in a language other than English.
Informed consent is not only a patient’s right but it’s also a legal and regulatory requirement that ensures patients (or their legally authorized representatives – LAR) understand and voluntarily agree to a proposed procedure or treatment.
Obtaining/Documenting informed consent: The provider (including residents/fellows) performing the procedure or treatment should be obtaining and documenting informed consent.
